Our lives changed forever when our daughter was involved in a devastating car accident. As a passenger, she had no control over what happened, yet she has paid the highest price. The injuries she suffered left her in a permanent vegetative state. To make matters worse, those responsible failed to render aid when she needed help most.
This tragedy exposed a significant gap in our criminal justice system. Current laws often fail to adequately address situations where reckless or negligent actions leave a victim permanently incapacitated. Families like ours are left to endure a lifetime of emotional, physical, and financial hardship while the legal consequences for those responsible may not reflect the severity of the harm caused.
Across the United States, thousands of families face similar circumstances every year. Serious traffic accidents leave many victims with life-altering brain injuries and other catastrophic conditions that permanently change their lives and the lives of those who care for them.
We are calling on lawmakers to create and strengthen criminal penalties for cases in which a person's reckless, negligent, or unlawful actions result in a victim being left in a permanent vegetative state or similarly catastrophic condition. The law should recognize the profound and lasting impact of these injuries and ensure that accountability reflects the magnitude of the harm.
In addition, the law must include meaningful penalties for individuals who fail to render aid after causing or contributing to a serious injury. Abandoning a victim in a moment of crisis is a grave act that should carry serious legal consequences.
